Mr. Pletten:

The Attorney General for the State of Michigan is fully aware of the extent to which cigarettes are sold in this state

The City Clerk is not a decision maker as to enforcement action of state statutes.

Direction on enforcement would likely need to come from the Attorney General to local law enforcement. [See Michigan rebuttal.]   I am unaware of any such direction.

However, you are welcome to take this up with the Sterling Heights Police Department, but anticipate a similar response.

Sincerely,

Thank you.  What about the Sterling Heights Police Department enforcing Michigan law MCL § 750.27, MSA § 28.216?

Mr. Pletten:

There is no license required from the City to sell cigarettes. There is only a business registration requirement.

My only suggestion is that you contact the Attorney General's Office for the State of Michigan and inquire as to their enforcement regarding the sale of tobacco products as they are generally the enforcement agency for such issues. I do believe the State of Michigan was part of a multi-state civil litigation and settlement against the companies that manufacture and / or sell cigarettes.

Thank you.

Sincerely,

Dear Sir:

Businesses referred to are such as grocery stores, dollar stores, gas stations, etc., that sell in violation of Michigan law MCL § 750.27, MSA § 28.216.

Mr. Pletten:

My apologies for not getting back to you earlier today.

Businesses must annually register with the City. Some activities require a license, such as a junkyard. It varies depending on the operation. Do you have a business that you are referring to so I can give you a more informative response?

Sincerely,

Mark Carufel

City Clerk

 Dear Mark Carufel, City Clerk:

1. Do businesses in the City require a license?

2. If so, and if a business is violating a State Law, what is the procedure to secure revocation or suspension of the license?

Thank you.
